FEC joins call to throw out suit against Obama

Montgomery County man's allegation of foreign birth is 'patently false,' agency says.

The Federal Election Commission has joined Barack Obama and the Democratic National Committee in asking a federal judge to dismiss a lawsuit filed by a Montgomery County attorney seeking Obama's ouster from the November ballot.

Philip Berg, who claims the Illinois senator was born in Kenya and can't run for president because he isn't a natural-born U.S. citizen, has no standing to make the claim, according to the FEC.

The motion, filed Tuesday in U.S. District Court in Philadelphia, echoes one filed last month by Obama and the DNC that states Berg hasn't demonstrated how he personally would suffer even if his ''ridiculous and patently false'' claims were true.

The FEC says Berg would have to claim a ''concrete and particularized'' injury. But he ''has done nothing more than assert a generalized grievance on behalf of the American citizenry and his fellow voters,'' and courts have tossed claims made on behalf of ''such all-encompassing groups.''


Berg, of Lafayette Hill, sued Obama in August, also naming the DNC and the commission.

The FEC says it should be dismissed as a defendant even if Berg had standing because ''it has no power to determine who qualifies for ballot access or who is eligible to serve as president.''

This is getting completely absurd. If the Federal election Commission can't determine who is eligible to serve as president (make him prove that his is a naturnal born citizen) then who can? The Supreme Court can't make a quick ruling and Hawaii won't even consider the case until November 7th.

How are those people going to react when the rest of us say "You say the rules don't apply to you, why should they apply to me?"
