Post Feres Doctrine

One of my very best friend had his hip broken in Basic Training by the negligence of two Drill Sergeants. The VA has taken care of him medically for the rest of his life the sergeants were busted but he has no other recourse. He should have been able to sue the Army for negligence but can't. Yet, I can also see that in the heat of battle there needs to be some protection for dumb decisions made under the stress of battle. And, in war even if everything is done right people will get hurt and killed. The Feres act, if it is replace would have to be done carefully so as to offer protection to those who make decision in time of war. Just repealing the Feres Act without replacing it with something else would open a floodgate of law suits, many frivolous. The Feres Act did have a purpose and I believe its brush strokes are way to broad and needs to be changed but with much wisdom!
