Trump and Palm Beach

Trump has a law suite against Palm Beach for freedom of expression. Palm beach has city ordnance's and city zoning codes.
Seems the city says you can have a flag that is 4 feet by 6 feet on a pole that is a max in hight of 42 feet. That would be good enough for most people in the country, except Don.
Don's flag is 40 feetX 50 feet on a 80 foot pole.
The reason palm beach looks the way it does is because of Zoning codes and ordnance's , other wise there would be old Chevy's jacked up in the front yard next to the camp fire.
The city is fining Don $1000. a day for the flag. Don says the flag will stay and when he wins his law suite the money will go to the vets coming home from Iraq.
If a jury fine sin favor of Don, that will sure put a big fat wrench in the Zoning ordenences of cities.
People that move to a city and sign a deed contract have got to know what the restrictions are just as Home owners association rules. If you don't like the rules or the ordnances don't live there.
The community as a whole usually are responsible for the restrictions.
Don has a lot of money and the city can do nothing except fine
him and that makes no difference to Don. You got money, you can do anything you want.
The jury should send Don a little message. Increase the fine to 10 million a day and find in favor of the city. There ya go Don.

Ya got it, Ron. I'm as patriotic as the next guy and fly a flag everyday but Trump thinks with all his money he can get away with anything.

Zoning is zoning. If you can't abide by the code don't live there. The problem will be that the city probably won't be able to afford the cost of endless litigation and Trump will get his way.

The Palm Beach situation isn?t about flag waving or anything like patriotism at all, it?s just Trump?s outsized ego giving people an up-yours n? tying to bully and intimidate with cubic dollars.

here is something to support Donald Trumps right to fly his US Flag in his front yard (sic), During the last week of July 2006, President George Bush signed the Freedom to Display the American Flag Act of 2005, allowing residents to display the flag on their residential property despite any homeowners association rules. It does not state in this Act any specs on how big or small the display can be so using this Law as a legal precedent Donald Trump will prevail in court just like Jupiter resident George Andres did after JEB Bush helped him keep his US flag, Mr Andres was a retired Marine if I remember correctly

The Freedom to Display Act only prohibits the following:

"SEC. 3. RIGHT TO DISPLAY THE FLAG OF THE UNITED STATES.

A condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent a member of the association from displaying the flag of the United States on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use."

As I read it it does not say anything about a community's zoning regulations, it that is what is alleged to be violated in Palm Beach.

Maybe The Donald does live in a condo or co-op and may be covered.

It's zoning regs not home owners. The cities zoning doesn't say he can't fly the flag , it's say he can fly a flag, 4'X6' on a pole no longer than 40 feet. Dons is 40'x50' on a 80 foot pole.
The thing the president signed may cover Don but then it may not.

Like all lawsuits it depends on how much money a person is willing to spend and how good a lawyer you have representing you. Who would have thought back in the days that some one could win a judgment against a restaurant for spilling coffee in your car driving? Now it happens all the time it seems.
