NEW JOBS See. 1221. Incentives to hire unemployed veterans and disconnected youth. _____________________________________ PART III-INCENTIVES FOR NEW JOBS SEC. 1221. INCENTIVES TO HffiE UNEMPLOYED VETERANS AND DISCONNECTED YOUTH. (a) IN GENERAL.-Subsection (d) of section 51 is amended by adding at the end the following new paragraph: "(14) CREDIT ALLOWED FOR UNEMPLOYED VETERANS AND DISCONNECTED YOUTH HIRED IN 2009 OR 2010.- "(A) IN GENERAL.-Anny unemployed veteran or disconnected youth who begins work for the employer during 2009 or 2010 shall be treated as a member of a targeted group for purposes of this subpart. "(B) DEFINITIONS.-For purposes of this paragraph- "(i) UNEMPLOYED VETERAN.-The term 'unemployed veteran' means any veteran (as defined in paragraph (3) (B), determined without regard to clause (ii) thereof) who is certified by the designated local agency as- "(I) having been discharged or released from active duty in the Armed Forces at any time during the 5-year period ending on the hiring date, and "(II) being in receipt of unemployment compensation under State or Federal law for not less than 4 weeks during the 1-year period ending on the hiring date.

Economic recovery payment to recipients of social security, supplemental security income, railroad retirement benefits, and veterans disability compensation or pension benefits.(iii) VETERANS BENEFIT.-A benefit payment described in this clause is a compensation or pension payment payable under- (I) section 1110, 1117, 1121, 1131, 1141, or 1151 of title 38, United States Code; (II) section 1310, 1312, 1313, 1315, 1316, or 1318 of title 38, United States Code; (III) section 1513, 1521, 1533, 1536, 1537, 1541, 1542, or 1562 of title 38, United States Code; or 0: \ERN\ERN09560.LC S.L.C. 385 1 (IV) section 1805, 1815, or 1821 2 of title 38, United States Code, 3 to a veteran, surviving spouse, child, or 4 parent as described in paragraph (2), (3), 5 (4)(A) (ii), or (5) of section 101, title 38, 6 United States Code, who received that ben- 7 efit during any month within the 3 month 8 period ending with the month which ends 9 prior to the month that includes the date 10 of the enactment of this Act. ___________________________________________ (iii) VETERANS BENEFIT.-A benefit payment described in this clause is a compensation or pension payment payable under- (I) section 1110, 1117, 1121, 1131, 1141, or 1151 of title 38, United States Code; (II) section 1310, 1312, 1313, 1315, 1316, or 1318 of title 38, United States Code; (III) section 1513, 1521, 1533, 1536, 1537, 1541, 1542, or 1562 of title 38, United States Code; or 0: \ERN\ERN09560.LC S.L.C. 385 1 (IV) section 1805, 1815, or 1821 2 of title 38, United States Code, 3 to a veteran, surviving spouse, child, or 4 parent as described in paragraph (2), (3), 5 (4)(A) (ii), or (5) of section 101, title 38, 6 United States Code, who received that ben- 7 efit during any month within the 3 month 8 period ending with the month which ends 9 prior to the month that includes the date 10 of the enactment of this Act. 11 (C) SSI CASH BENEFIT DESCRIBED.-A 12 SSI cash benefit described in this subparagraph 13 is a cash benefit payable under section 1611 14 (other than under subsection (e)(l)(B) of such 15 section) or 1619(a) of the Social Security Act 16 (42 U.S.C. 1382, 1382h). 17 (2) REQUIREMENT.-A payment shall be made 18 under paragraph (1) only to individuals who reside 19 in 1 of the 50 States, the District of Columbia, 20 Puerto Rico, Guam, the United States Virgin Is- 21 lands, American Samoa, or the Northern Mariana 22 Islands. For purposes of the preceding sentence, the 23 determination of the individual's residence shall be 24 based on the current address of record under a pro- 25 gram specified in paragraph (1). O:\ERN\ERN09560.LC S.L.C. 386 1 (3) No DOUBLE PAYMEN'l'S.-An individual 2 shall be paid only 1 payment under this section, re- 3 gardless of whether the individual is entitled to, or 4 eligible for, more than 1 benefit or cash payment de- 5 scribed in paragraph (1). 6 (4) LIMITATION.-A payment under this section 7 shall not be made- 8 (A) in the case of an individual entitled to 9 a benefit specified in paragraph (l)(B)(i) or 10 paragraph (l)(B)(ii)(VIII) if, for the most re- 11 cent month of such individual's entitlement in 12 the 3-month period described in paragraph (1), 13 such individual's benefit under such paragraph 14 was not payable by reason of subsection (x) or 15 (y) of section 202 the Social Security Act (42 16 U.S.C. 402) or section 1129A of such Act (42 17 U.S.C. 1320a-8a); 18 (B) in the case of an individual entitled to 19 a benefit specified in paragraph (l)(B)(iii) if, 20 for the most recent month of such individual's 21 entitlement in the 3 month period described in 22 paragraph (1), such individual's benefit under 23 such paragraph was not payable, or was re- 24 duced, by reason of section 1505, 5313, or 25 5313B of title 38, United States Code; 0: \ERN\ERN09560.LC 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 S.L.C. 387 (C) in the case of an individual entitled to a benefit specified in paragraph (l)(C) if, for such most recent month, such individual's benefit under such paragraph was not payable by reason of subsection (e)(1)(A) or (e)(4) of section 1611 (42 U.S.C. 1382) or section 1129A of such Act (42 U.S.C. 1320a-8a); or (D) in the case of any individual whose date of death occurs before the date on which the individual is certified under subsection (b) to receive a payment under this section. (5) TIMING AND MANNER OF PAYMENTS.- (A) IN GENERAL.-The Secretary of the Treasury shall commence disbursing payments under this section at the earliest practicable date but in no event later than 120 days after the date of enactment of this Act. The Secretary of the Treasury may disburse any payment electronically to an individual in such manner as if such payment was a benefit payment or cash benefit to such individual under the applicable program described in subparagraph (B) or (C) of paragraph (1). (B) DEADLINE.-No payments shall be disbursed under this section after December 31, 0: \ERN\ERN09560.LC S.L.C. 388 1 2010, regardless of any determinations of enti- 2 tlement to, or eligibility for, such payments 3 made after such date. 4 (b) IDENTIFICATION OF RECIPIENTS.-The Commis- 5 siOller of Social Security, the Railroad Retirement Board, 6 and the Secretary of Veterans Mfairs shall certify the in7 dividuals entitled to receive payments under this section 8 and provide the Secretary of the Treasury with the infor9 mation needed to disburse such payments. A certification 10 of an individual shall be unaffected by any subsequent de II termination or redetermination of the individual's entitle 12 ment to, or eligibility for, a benefit specified in subpara 13 graph (B) or (C) of subsection (a)(l). 14 (c) TREATMENT OF PAYMENTS.- 15 (1) PAYMENT TO BE DISREGARDED FOR PUR- 16 POSES OF ALL FEDERAL AND FEDERALLY ASSISTED 17 PROGRAMS.-A payment under subsection (a) shall 18 not be regarded as income and shall not be regarded 19 as a resource for the month of receipt and the fol- 20 lowing 9 months, for purposes of determining the 21 eligibility of the recipient (or the recipient's spouse 22 or family) for benefits or assistance, or the amount 23 or extent of benefits or assistance, under any Fed- 24 eral program or under any State or local program fi- 25 nanced in whole or in part with Federal funds. 0: \ERN\ERN09560.LC S.L.C. 389 1 (2) PAYMENT NOT CONSIDERED INCOME FOR 2 PURPOSES OF TAXATION.-A payment under sub- 3 section (a) shall not be considered as gross income 4 for purposes of the Internal Revenue Code of 1986. 5 (3) PAYlV[ENTS PROTECTED FROM ASSIGN- 6 MENT.-The prOVISIOns of sections 207 and 7 1631(d)(1) of the Social Security Act (42 U.S.C. 8 407, 1383(d)(1)), section 14(a) of the Railroad Re- 9 tirement Act of 1974 (45 U.S.C. 231m(a)), and sec- 10 tion 5301 of title 38, United States Code, shall 11 apply to any payment made under subsection (a) as 12 if such payment was a benefit payment or cash ben- 13 efit to such individual under the applicable program 14 described in subparagraph (B) or (C) of subsection 15 (a)(l). 16 (4) PAYMENTS SUBJECT TO OFFSET.-Notwith- 17 standing paragraph (3), for purposes of section 18 3716 of title 31, United States Code, any payment 19 made under tIns section shall not be considered a 20 benefit payment or cash benefit made under the ap- 21 plicable program described in subparagraph (B) or 22 (C) of subsection (a)(l) and all amounts paid shall 23 be subject to offset to collect delinquent debts.

Shoot..I`m all for this bill. Let`s wait and see what happens with it, as we`re always on the lying lips of politicos in election season; "And it`s Tommy this and Tommy that.."
What we`re after here is what is this grotesque spending spree doing for veterans? I mean, you`d think that in dropping a cool trillion in "stimulation spending", the dems might at least throw us a friggin bone.

Below is the statement by Congressman Chet Edwards (Democrat/Texas) in Response to Criticism of Veterans Funding in the 2009 American Recovery and Reinvestment Act WASHINGTON, PRNewswire-USNewswire/ -- U.S. Representative Chet Edwards released the following statement in response to criticism of veterans funding in the 2009 American Recovery and Reinvestment Act. "It has been said that it is easier to kick down a barn than to build one. That appears to be the case regarding criticisms of veterans funding in this bill. Regarding Congressman Steven Buyer's (Republican/Indiana) and other republicans criticism of the bill, let me point out that the Democratic Congress has increased veterans health care and benefits funding by more in two years than the Republican-led House did in 12 years, including his (Buyers) years as Chairman of the House VA Committee. In 2007 and 2008 alone, the Democratic-led Congress increased veterans funding by $16.3 billion, which is more than House Republicans did collectively from 1995 through 2004. In addition to the $16.3 billion increase by Democrats in just two years, we also passed a historic 21st Century GI Education bill, which matched the education benefits of the World War II GI Bill. Having passed a new GI Education bill and $16.3 billion in new funding in 2007 and 2008 for veterans, the 2009 stimulus bill adds $1.4 billion in additional funding to modernize our VA hospitals and $2.98 billion to modernize DOD hospitals, barracks and day care centers. For Republicans such as Mr. Buyer to vote against and criticize the additional $1.4 billion for veterans after underfunding VA programs for over a decade makes his criticisms look more partisan than substantive. The difference is clear. Democrats in just over two years have provided unprecedented increases in funding for VA programs, and Republicans' record for veterans never matched their rhetoric. That's a fact." Military Construction Funding in H.R.1 Conference Report: Hospitals: $1.33 billion to recapitalize our aging military hospitals and ambulatory centers. Many of these facilities are 40 or even 50 years old, and are not suited to current medical standards and practices. Troop and family housing: $335 million to build new barracks and dormitories for our soldiers, sailors, marines, and airmen as well as further investments in quality family housing. Child Care: $240 million for new child development centers on base. These facilities will help military spouses hold down jobs, and provide employment opportunities for caregivers. National Guard: $100 million for the Army and Air National Guard. This will support our reservists who have been heavily deployed in recent years, as well as States who need Guard units for disaster assistance and homeland security. Homeowners Assistance Fund: $555 million for assistance to military homeowners, including wounded warriors and surviving spouses, who have been impacted by the housing crisis. Wounded Warriors: $100 million for warrior transition complexes to provide services to wounded warriors and their families. Energy Conservation Investment Program: $120 million to make military facilities more energy efficient and save taxpayers money. Veterans Affairs Funding in H.R. 1 Conference Report: Medical Facilities: $1.0 billion for non-recurring maintenance, including energy projects, to address deficiencies and avoid serious maintenance problems at the 153 VA hospitals. National Cemetery Administration: $50 million for memorial maintenance, including those identified in the 2002 Millennium Act report to Congress, for the National Cemetery Administration.
