Jenkins the Deserter
Is this really a good time to be pedantic? The Japanese in the street see this guy as a romantic hero (his story does put most romantic thriller fiction to shame) and they want to give him a home.
With our world image the way it is right now, I can't see how starting a diplomatic row with an already shaky ally is going to help anybody. I dunno. Obviously a statute of limitations on outright treason (assuming he wasn't brainwashed like his family says) isn't an option, but it just seems a bit small to be chasing down a long-forgotten sarge who's probably not long for this world anyway. Is it wrong to just pretend we don't notice him and let him live with himself and what he's done?

I can't think of a worse sentence than life in North Korea.

I?d say let it go as nothing productive will come of pressing the point. Probably just making the obligatory noises is enough. Almost by definition the UCMJ comes into conflict with other needs in situations like this and I can?t help but think of the case of Bobby Garwood. Not a pretty sight from any standpoint.
During the cold war with the Soviets, it was a common thing for the USN and the Bear Navy to be pushing and shoving, intimidating and literally trading paint by side swiping each other. The favored Bear trick was to line up their garbage and dump it all on the deck of the USN Ship as they sideswiped. The USN antidote for this was to set up the high-pressure fire hoses and knock down the Bear trashcans at the moment of truth. Tit for tat kind of thing I suppose. During one of these episodes a Bear Sailor jumped onto the deck of the USN Destroyer and requested asylum, or so it was related. As this saga circulated among the US lefties, the hue and cry went up and soon enough the jump turned into a fall, then into being grabbed and kidnapped. At the end of the arguing back and forth, the Bear Sailor was turned over to Soviet Navy authorities and no doubt he didn?t see the next dawn. No moral to that story other than shit happens and victims are victims, nothing more. Scamp
