New Court Ruling
Wins Stay - Claims Can Be Held
-------------------------------------------------------------------------------- On April 13, the US Court of Appeals for Veterans Claims ruled in favor of advancing the claim of Nicholas Ribaudo as well as other compelling (hardship) cases then-docketed with the Board of Veteran Appeals. However, it uphelp the VA?s motion to stay the effect of Haas and dismissed all other elements requested in the NCLSP filing. That means that the USCAVC has ruled it legal for the VA to sit on all other Blue Water Navy claims for Agent Orange compensation. This Stay Order will remain in effect until the final ruling on the Haas Case is rendered by the U.S. Court of Appeals for the Federal Circuit. Here is the Full Court Opinion for this Ruling. Wins Stay - Claims Can Be Held -------------------------------------------------------------------------------- All Vietnam Veterans (Not Vietnam Era) who served on land or in the contigious waters were exposed to Agent Orange. The VA is covering this up, changing the Rules(M21 Manual) on how to apply disability to Vetereans of the Sea and Air Services - all due to money. This is a real shame and a disgrace that our elected officals have taken not taken a position for the Vietnam Veteran or the Veterans from the Vietnam war. The evidence is overwhleming that those exposed suffer the same on land with even a greater exposure for those who were at sea due to the higher levels of the exposure. The SEA Water was poluted and when new waters was made by the evaporators there was a 4-1 + concentration rate. This VA rulings needs to be in favor of the Vietnam Veteran or these issues will be the same for the Iraq, Afganastan and all war veterans of all wars and conflicts who come after them. The cost of war is what it is and the country needs to be responsible for the exposure.
