EXCLUSIVE: Rep. Lamar Smith issues first DOJ oversight letter

Right Turn has obtained the first oversight letter from House Judiciary Committee Chairman Lamar Smith (R-Texas) issued to the Justice Department. While he was in the minority, Smith labored, largely unsuccessfully, on the committee to convince the Democratic chairman to investigate a range of issues, including detainee policy and New Black Panther Party case. He now has the authority to schedule hearings, call witnesses and subpoena documents.

In a five-page letter, Smith notes that there has been "little oversight" as to how the civil rights division has used its budget increases ($22 million in FYI 2010 and $17 million requested in FYI 2011) and why the need for some 164 new positions.

He then gets to the heart of the matter. As I and other outlets have reported, he notes that in the New Black Panther Party case investigation, it came to light that a political appointee, Julie Fernandes, directed Justice Department attorneys "not to bring cases against black defendants for the benefit of white victims."

Smith then details allegations by former Justice Department attorney J. Christian Adams that the department declined to enforce the National Voter Registration Act and its provisions relating to "voter integrity."

After reciting the evidence concerning Fernandes's statements and her expressed hostility toward enforcing the NVRA, Smith concludes, "Allegations that the Civil Rights Division has engaged in a practice of race-biased enforcement of voting rights law must be investigated by the Committee." He then gives Holder until January 21 to respond to a list of questions, including whether Fernandes did, in fact, "explicitly or implicitly direct Voting Section staff not to enforce any section of any federal rights statute" or "not to enforce Section 8 of the National Voter Registration Act." He demands all documents that relate to the department's enforcement practices under the Voting Rights Act.

The letter is noteworthy on a number of levels. First, administration flacks and liberal bloggers have insisted that the New Black Panther Party case is much to do about nothing. But as Smith has correctly discerned, the issue of enforcement or non-enforcement of civil rights laws based on a non-colorblind view of those laws is serious and a potentially explosive issue for this administration. Second, Holder's strategy of stonewalling during the first two years of Obama's term may have backfired. Had he been forthcoming while Democrats were in the majority, he might have been able to soften the blows; Smith is not about to pull his punches. And finally, Smith is demonstrating the sort of restraint and big-picture focus that is essential for the Republicans if they are to remain credible and demonstrate their capacity for governance.

UPDATE: 3:50 p.m. Clarification was added above that the budget increases relate to the civil rights divison only and the $17M was requested but not allocated in FYI 2011.

Guess it fair saying in now dictated favoring & capitulating to MOST ALL (even to obvious Racists & Race Supremacists) Black & Brown Racial Demands by Officialdom, in that Department of Justice & Civil Rights Division are both QUITE GUILTY AS CHARGED.

Even duped followers of Democrat/Socialist/Leftist/Marxist and/or Progressive Political Supremacists posing as Liberals, largely supportive mainstream press/media & multitude of quite wealthy anti-America charlatan zealot notables cannot HONESTLY deny all above.

Whereas & typically as most such Liberal Phonies most often do,...all obvious truths aforementioned will just be scoffingly & laughingly denied or either blamed on Bush (or both).

Regardless,...U.S. Political Ruling Elite better soon get back to enforcing EQUALITY for-a-change. Our current Obama Ordered & Holder Enforced MINORITY RULE has just gotten to be to-damn-much to put up with.

And besides, if American Colonials didn't obediently (meekishly & stupidly also) accept Total British Rule and/or from greatest military force of the time pre-1776,...why-in-the-hell stupidly put up with an already worldwide proved failure and/or DICTATORIAL MARXIST IDEOLOGY now, anyway? Hell,...even Russians admit that communism doesn't work.

Still, and for some worried that Barry or Barack & Eric will absurdly sue all other states just like Arizona for whatever LAWS "He" quite lordly dislikes,...I just don't know what to say?

Maybe we should just Illegally IMMIGRATE (some joke) to Costa Rica, Guatemala, Mexico & such?

That the weather is better & the livin is MUCH CHEAPER for Housing, Food & Medical or whatever down there...are no jokes.

Gee! I wonder why that is? Are "Their" Rulers & Regulators that much wiser? Or, could it be that "They" just have much fewer Rulers & Regulators?

Most all of: "The faces of insurrection" seem presently & historically accurate to me, excepting patriots Custer (my old boss ), O'Reilly & a few others mixed into that quite large groupng of despicably dangerous ideologue zealots.

In fact, I don't see how either: "Custer, O'Reilly & a few others" can even be tied-in with such anti-America & basically anti-Liberty & Freedom Marxist (Muslim also) demigod nuts.

It's just an attempt to get a mind picture of who all is involved in being, essentially, an instigator, someone who, if given a choice, would rather poke us in the arm with a stick than to just make mention of something they thought we needed to be aware of.

To my way of thinking, Custer and O'Reilly are related in that way.

This one also seems like a very good: "Work in progress". But, here too old knit-pickin-Neil finds a few faces questionable as to actually: "Faces of Peace,...and also why such good stuff is even over here on pretty-much back burner since never flagged: "Political Debate" forum, anyway?

Regardless, the face that truly stands oddly out to me is Hugh Heffner. A couple others could be considered either way,...and some I just ignorantly don't even know whom they are.

With: "Heff", just can't be sure whether it's promoting fine: "Peace" or fine Pieces that are being alluded to, instead.

I didn't mean to hijack this good thread on such an important matter - the photo essays are just my little way of trying to make sense of nonsense, really.

I find that putting faces on the speech helps, a little.

How the AG can possibly expect there to be total acceptance of his department's position on this issue suggests a degree of arrogance which is, frankly, very threatening and which will, in my opinion, make worse the already angry among us who rightly see his position as 100% utterly racist - in a long number of years of the same.

Commission Report: DOJ Stifled Investigation Into New Black Panther Party and Voter Intimidation Charges

Attorney General Eric Holder and others within the U.S. Department of Justice prevented members of the U.S. Commission on Civil Rights from conducting a complete and thorough investigation of the department’s decision to drop charges against members of the New Black Panther Party for their 2008 election day actions in Philadelphia.


Members of the commission issued what should be regarded as a stinging indictment of AG Holder and the Justice Department in one paragraph of a news release issued today about the investigation trying to answer the question of whether DOJ practiced race-neutral enforcement of the law:

Although such testimony supported the need for thorough investigation, DOJ continued to withhold relevant documents and preclude relevant officials and supervisors from testifying.

The Commission was thus limited in its ability to complete a final report. As a result, the Commission has issued an interim report that describes the evidence that has been collected up to this point and the lack of cooperation by the Department of Justice.

In a separate paragraph, appearing on page iii of the interim report addressed to President Barack Obama, Senate Majority Leader Harry Reid (D-Nev.) and Speaker of the House John Boehner (R-Ohio), Commission members highlighted the dilemma they face as a result of the DOJ’s obstruction:

The Commission, by a separate 5-2 vote breaking down along the same lines, found that although its statute authorizes the Commission to subpoena witnesses and written material and requires federal agencies to cooperate fully with its investigations, its authority to seek legal recourse when the Attorney General refuses to enforce Commission subpoenas, as has occurred repeatedly during this investigation, is unclear.


of the Nov. 4, 2008, incident that triggered public outcry is clear to any objective viewer: Billy club-carrying members of the New Black Panther Party were intimidating voters outside a Philadelphia polling place.

It will be interesting to see whether any state-run media outlets report AG Holder’s obstruction of justice and apparent racist enforcement of the law.
