The Amnesty Memo

According to an internal U.S. Citizenship and Immigration Services memo going the rounds of Capitol Hill and obtained by National Review, the agency is considering ways in which it could enact “meaningful immigration reform absent legislative action” — that is, without the consent of the American people through a vote in Congress.
“This memorandum offers administrative relief options to . . . reduce the threat of removal for certain individuals present in the United States without authorization,” it reads.
Also: “In the absence of Comprehensive Immigration Reform, USCIS can extend benefits and/or protections to many individuals and groups by issuing new guidance and regulations, exercising discretion with regard to parole-in-place, deferred action and the issuance of Notices to Appear (NTA), and adopting significant process improvements.”
In recent weeks, Sen. Chuck Grassley and others in Congress have been pressing the administration to disavow rumors that a de facto amnesty is in the works, including in a letter to Department of Homeland Security head Janet Napolitano. “Since the senators first wrote to the president more than a month ago, we have not been reassured that the plans are just rumors, and we have every reason to believe that the memo is legitimate,” a Grassley spokesman tells NR. (NR contacted DHS, but a spokesman did not have a comment on the record.)

Many of the memo’s proposals are technical and fine-grained; for example, it suggests clarifying the immigration laws for “unaccompanied minors, and for victims of human trafficking, domestic violence, and other criminal activities.” It also proposes extending the “grace period” H-1B visa holders have between the expiration of their visa and the date they’re expected to leave the country.

With other ideas, however, USCIS is aiming big. Perhaps the most egregious suggestion is to “Increase the Use of Deferred Action.” “Deferred action,” as the memo defines it, “is an exercise of prosecutorial discretion not to pursue removal from the U.S. of a particular individual for a specific period of time.” For example, after Hurricane Katrina, the government decided not to remove illegal immigrants who’d been affected by the disaster.
The memo claims that there are no limits to USCIS’s ability to use deferred action, but warns that using this power indiscriminately would be “controversial, not to mention expensive.” The memo suggests using deferred action to exempt “particular groups” from removal — such as the illegal-immigrant high-school graduates who would fall under the DREAM Act (a measure that has been shot down repeatedly in Congress). The memo claims that the DREAM Act would cover “an estimated 50,000” individuals, though as many as 65,000 illegal immigrants graduate high school every year in the U.S.
In the immediate wake of the court decision blocking the Arizona immigration law yesterday, the memo is sure to create controversy — and the sense that the administration is bent on preserving and extending the nations de facto amnesty.
UPDATE: USCIS has released a statement on the memo:
Internal draft memos do not and should not be equated with official action or policy of the Department. We will not comment on notional, pre-decisional memos. As a matter of good government, U.S. Citizenship and Immigration Services (USCIS) will discuss just about every issue that comes within the purview of the immigration system. We continue to maintain that comprehensive bipartisan legislation, coupled with smart, effective enforcement, is the only solution to our nation’s immigration challenges.
Internal memoranda help us do the thinking that leads to important changes; some of them are adopted and others are rejected. Our goal is to implement policies wisely and well to strengthen all aspects of our mission. The choices we have made so far have strengthened both the enforcement and services sides of USCIS — nobody should mistake deliberation and exchange of ideas for final decisions. What the ‘Amnesty Memo’ Means

Majority Leader Harry Reid and Speaker Nancy Pelosi are facing a dilemma:

Although they publicly bemoan the fact that Republicans won’t help them pass an unpopular amnesty . . . er, comprehensive immigration-reform bill, they don’t want to force vulnerable Democrats to vote on amnesty this close to the November elections — especially not with unemployment at 9.5 percent.

Sen. Chuck Grassley (R., Iowa) may have uncovered the answer to their dilemma yesterday: an internal U.S. Citizenship and Immigration Services memo (reported here on NRO) that outlines steps the Obama administration can take “in the absence of Comprehensive Immigration Reform” — that is, lawfully enacted amnesty — to “reduce the threat of removal for certain individuals present in the United States without authorization.”

The four authors of the memo, titled “Administrative Alternatives to Comprehensive Immigration Reform,” are political appointees USCIS chief of policy and strategy Denise Vanison (a former immigration attorney and partner at Patton Boggs) and USCIS chief counsel Roxana Bacon (former general counsel for the American Immigration Lawyers Association), and two career employees of USCIS director Alejandro Mayorkas, another Obama appointee.

The U.S. Constitution gives Congress — and only Congress — the authority to decide federal immigration law, but the Obama administration has come up with an extensive list of ways to ensure that a majority of the illegal aliens in the United States are allowed to remain here.

Here are just three examples of the outrageous proposals in the memo:

● USCIS could grant “parole-in-place,” which comes with a work permit and the ability to obtain a green card, to certain classes of aliens who entered the country illegally. Such classes would include those who entered as minors and those who “have lived for many years in the U.S.” A nice reward for those who have successfully violated the law for the longest period of time.

● For those who overstay their visas, the memo recommends granting “deferred action,” which means that deportation is deferred indefinitely and the illegal alien can apply for a work permit. The memo suggests two particular categories of illegal aliens for deferred action: those who might benefit if Congress were to pass the DREAM Act amnesty (of which there are 2.1 million, according to the Migration Policy Institute) and those “who have resided in the U.S. since 1996 (or as of a different date designed to move forward the Registry provision now limited to entries before January 1, 1972).” The “Registry provision” referred to is an actual federal law, not that it matters to the memo’s authors.

● To make sure no illegal alien is left behind, the memo suggests that DHS could simply stop issuing “Notices to Appear” (the document that starts the removal process for illegal aliens) unless the alien has a “significant negative immigration or criminal history.” Apparently, violating immigration law once or twice is acceptable. These folks wouldn’t be able to apply for a work permit, but since the Obama administration isn’t conducting worksite enforcement against illegal aliens much anymore, that shouldn’t matter.

No wonder Reid, Pelosi, and Obama seem content to avoid a legislative battle over immigration; the Department of Homeland Security is hard at work on ways to implement its own amnesty.

Hate to disagree with you.
But, and realistically, "His Barackness" & Gang stand as much chance of likely suffering an:
"Insurrection"...as Hitler, Tojo & Stalin did.

Basically, when dictatorial rulers control Most Everything (DOJ & Press also) NONE DARE REBEL.

Besides,...no people like being automatically pilloried as: "A Racist" just for being Honest and/or
calling Black (plus Half Black) Authoritarians flat-out Hypocritical Liars, or what actually are.

Sorry, Blue.
But we're all pretty-much stuck between Barack & Lords & A Hard Place.

Quite standardly, what an Imperial Big Brother wants...HE gets. It's that simple.
And besides,...isn't that what TOTAL CONTROL is actually all about, anyway?

Plus, and unless living in caves somewhere, most must've noticed that vaults actually have
much more: "Transparency" than America's current Dictatorial Regime typically display.

Wonder if all their many Secret Meetings at lordly-screwing-over America are recorded, either?
I seriously doubt it. Only Nixon was that stupid.

The longer this goes on, the more likely will be serious trouble.

Especially if there is no veto-proof majority won in Congress this November.

Redistricting is coming up next year too, and if that does not go the correct way as well, then...

Let's face it.
We basically non-represented or lorded-over Americans are being BSd bipartisan Big Time,...
which done mostly for foreign national vote garnering & increasing beholding voter base.

Also, we don't have an immigration problems that needs any: "Reforming". Any main reform of U.S. Immigration Statutes ever needed was called: "The Quota System". Such gave a quota for all entrants permitted from specific countries as NEEDED, whether for railroad construction, factory labor, farm work, or wherever else NEEDED in America.

Even way-back-when Criminally Illegal Aliens were nothing more than border jumping or trespassing Criminally Illegal Aliens or just International Lawbreakers jumping way ahead of those waiting patiently in line to immigrate here.

Some TRUE immigrants even wait 10-15-20 years for legitimately coming to America.

Regardless, don't be fooled by American Politicos & Press duplicitously renaming such as: "Illegal Immigrants". It's pure BULL conjured up to deceive American Citizenry into accepting dictates permitting our MASSIVE & LONGTIME: "Criminally Illegal Alien Invasion",...with nary a whimper. It's modern political variation of: "...keep the natives from getting restless".

Only Legitimate or Bonafide Immigrants are worth considering & being concerned about in America, by normal American workers & producers.

Any foreign nationals here (legally or otherwise) in dire straits or in need of some sort of assistance physically, financially or even schooling-wise,...should contact their respective embassies. That's what embassies are for & there are many of such in America.

That's what We Americans must do if having any difficulties overseas or abroad.

Also, I just can't believe that even El Supremo or: "His Barackness" thinks We U.S. $ucker$ should Marxist-like: "Share The Wealth" WORLDWIDE!!! But, hey. Who-the-hell-knows what Barry or Barack will dictate or try sliding PAST Congress & down our throats, NEXT?

Wish he would play more golf, take more vacations & spend less cavalierly generous time at The Public Troth. Don't think We Americans can handle much more of his on-the-job Lordly Preferrential & Progressive Gifting to Failed Unions & Corporations.

Besides,...This is America. Not Venezuela or even Russia. Isn't it?
