Hope for Coleman? Court Rules All Disputed Absentee Ballots Must be Evaluated and, If Valid, Counted

A pool of 4800 ballots, many of which Coleman pressed to be counted. So it's not unimaginable that the 220+ votes necessary to swing the election will be found in there.

The judges left seven highly specific categories in which previously rejected absentee ballots could still be counted, including ballots from overseas servicemembers that lack their original ballot application and ballots where the voter's witness didn't provide their street address.

But they also closed off some categories where Coleman had identified a number of potential votes to be added. That includes overseas servicemember ballots that were received late and unregistered voters who failed to get their registration material because of government error.

Coleman loses; case set for state Supreme Court

Al Franken was named the winner of Minnesota’s Senate race Monday by a three-judge panel.

The result was expected after the panel ruled against Republican Norm Coleman’s campaign on some key points in his contest of the Democrat Franken’s victory. Coleman’s lawyers immediately reiterated their vow to appeal to the state Supreme Court.


"More than 4,400 Minnesotans remain wrongly disenfranchised by this court's order,” said Coleman attorney Ben Ginsberg. “The court's ruling tonight is consistent with how they've ruled throughout this case but inconsistent with the Minnesota tradition of enfranchising voters.”


Franken’s lawyers have stated that Coleman stands little chance in the state high court, but even if that holds true, Coleman has also signaled he may appeal to federal courts.

“The problem that former Sen. Coleman has is he lost fair and square," Franken attorney Marc Elias told KSTP-TV. “He lost because more people voted for Al Franken than voted for Norm Coleman. No amount of lawyering or sophisticated legal arguments is going to change that."

Franken is still unlikely to receive the certificate of election he will probably need to be sworn into the Senate. Gov. Tim Pawlenty (R), who is responsible for signing such a certificate, has indicated that Minnesota law won’t allow him to sign it until Coleman has exhausted his case in state court.

If the case goes federal, Pawlenty has left open the possibility that the federal court could delay the signing of the certificate.

Coleman will have 10 days to formally appeal to the state Supreme Court.

Wish you or anyone for that matter could SENSIBLY (ie. apolitically) explain to me why ANY COURT in America must decide whether ANY ABSENTEE BALLOTS ANYWHERE in this country should be counted OR NOT??? Have American Courts their own separate Voting Rule Regulations that must be adhered to?

Isn't this ridiculously stretched-out Minnesota Voting Carnival and/or U.S. Court DENIAL of VOTES even: "LooneyTunes" by both pompously omnipotent and/or cavalier lordly political & judicial standards (or non-standards)?

Whatever happened to that: "One Man One Vote", once promised Americans? Do DNC hierarchy & supportive Press wants, wishes or demands superceed any such choices by The Voting Electorate?

Thus far,...it sure-as-hell seems so. Vote for a Republican and/or:"Party of Lincoln" type candidate,...and it broadcasted that you must be an Insensitive Bad Guy. Vote for A Democrat and/or historically once called: "Carpetbaggers" type of UN Lover,...and you automatically must be considered A Wonderful, All-Caring and: "Progressive" Good Guy.

It's too bad that some U.S. Courts actually adjudicate according to such Dem Hypocrisy.
Sure hope: "The Supremes" don't similarly act as lordly anti-"One Man One Vote"?

That's nice. Shouldn't bother: "The Supremes" so frivolously.

Still, wish someone would answer what basically first asked and/or what gives ANY Courts or
ANYBODY the right to determine which Absentee Ballots should be counted,...or should NOT?

Thought Your/My/Our or any American Citizens' Votes (Absentee Ballots or not) were ALL valid?
Wha-hoppened in Minnesota?
