As a teacher I can tell you that cell phones are a pain. I have had students use them to cheat on tests. When I see one in use I can, at my discretion, collect it, turn it in to an assistant principal and said student must go there after school to retrieve it. There is no legitimate reason for a student to use a cell phone during class and I can tell you some pretty amazing stories about low IQ folks and their cell phones.
If a parent wants to speak to his student there are procedures in place that provide for that. If those procedures were not in place we could get sued for allowing anyone free access to their student. Just like not everyone can pick a student up after school, not everyone has the right to call a student while school is in session. Personally, I would like to have one of those devices that block all cell phone calls for my classroom but they are illegal.
As for the teacher in question, that eggsucker was totally out of line and should desperately need a lawyer, or at least directions to the unemployment line. Education is a somewhat closed community and he has just tarred himself with a very black brush. The only hope he has is to go to CA. or MA.
